CCW while operating ATV or ORV

    The Ohio revised code section for prohibited acts for special Vehicles.
    ORC 4519.40 says prohibited act (5) while transporting any firearm, bow, or other implement for hunting, that is not unloaded and securely cased.
    The above would apply to a regular motor Vehicle as well but is excepted by the CCW permit.


    Is an ATV considered a motor Vehicle, motorcycle or prohibited from CCW while being operated? The 2013 handbook for CCW from the AG (attourneygeneral.gov) says Motorcycles fall under the definition of motor Vehicles. Thus, the same requirements apply to licensees who carry a handgun while on a motorcycle.(on page 12) therefore permitting loaded CCW.

    I am confused.
